Triple Talaq Verdict: 3 Year Jail For Ending Marriages Through Triple Talaq

On August 22, 2017, Triple Talaq has declared as an unconstitutional method of ending a marriage by Supreme Court in a 3:2 majority. After all the protests and support, Supreme Court has finally given the final verdict today.

Remember Shayra Bano? A brave 35-year old woman who came out with her anger on the divorce given by her husband, after 15 years of marriage. Shayara who is a mother of two, suffered a lot and then, her husband left her by just uttering a word three times! This was not the first time of this issue being raised, but thankfully, many Muslim women came out with their experiences and went to fight for their rights.

After everything said and done, Supreme Court declared this unethical way of ending a marriage illegal by the provisions of the Muslim Personal Law (Sharia) Application Act, 1937, which stands for the right of Muslim Women.

This story went viral overnight and more Muslim women shared their stories, which made this issue much more controversial. On the one hand some politicians and religious groups started protesting against the verdict, and on the other hand, the whole nation wanted justice for these women.

Triple Talaq Over!

On Friday, the Supreme Court said that the practice of triple talaq is the worst form of breaking a marriage among Muslims, and it should be eliminated from the society for a better world. A constitutional bench headed by Chief justice J S Khehar along with other hared the matter and declared the triple talaq as an illegal practice.
They have drafted a law that proposes the ban on instant triple talaq with three years in jail.

However, there are more than 50 cases after the verdict of instant triple talaq.

SC has already declared triple talaq as a non-bailable offense under the “Muslim Women Protection of Rights on Marriage Bill”. Now all the eyes will be on the Parliament’s winter session from 15 December.
